Terms and Conditions for Òran na Mara, Scaristavore, Harris, HS3 3HX
The following terms apply:
‘Owner’ shall mean Paul and Helen Honeywell.
‘Customer’ shall mean the individual who made the booking.
General Terms
The customer warrants that the property let is to be used for the purposes of a holiday and so
accepts that the lettings is a holiday let to which section 12(2) and paragraph 8 of Schedule 4 of
the Housing Scotland Act 1988 apply, namely “a tenancy the purpose of which is confer on the
tenant right to occupy the house for a holiday”
The customer must not sub-let the premises or any part thereof.
A contract is formed between the owner and customer when the customer has paid the deposit
and the owner has sent receipt.
Reservations
Bookings are made through our online booking system using SuperControl and Holiday Rent
Payment (Yapstone). At the time of booking you will have the option of allowing our payment
processor to hold your card details and take the balance payment automatically. Please note that
if your card is reissued for any reason, you will have to pay manually.
A 30% deposit is required to secure the reservation, payable at the time of booking. We take a
security deposit by holding £500, 7 days before arrival. This is automatically cancelled 7 days
after departure unless there is a claim. in which case we will notify you as soon as possible.
Available dates will be provisionally reserved for 10 days pending receipt of the deposit by cheque
or bank transfer, failing which the provisional reservation will be cancelled. On receipt of the
deposit the reservation will be confirmed. Reservations made within 8 weeks of arrival are
payable in full.
The reminding balance of payment is to be made no later than 12 weeks prior to arrival.
All reservations are subject to these terms and conditions.
Cancellations and Refunds
If you have to cancel your reservation for any reason please let us know by telephone or email
immediately. Once we have received this notice, the booking will be cancelled and the dates will
be released from the calendar. In the event of a cancellation we will make every effort to re-let the
property in which case we will return all monies paid.
We strongly advise taking out holiday insurance to protect you against the following additional
costs.
If we cannot re-let, cancellation costs will be incurred as follows:
More than 8 weeks before arrival will result in the loss of deposit
Less than 8 weeks you will be liable to pay the full rental (total of deposit & balance)
We take reservations in good faith that the house will be available on the date stated. If we are
unable to provide the accommodation for any reason beyond our control, we cannot guarantee
alternative facilities. In these circumstances, we will provide as much notice as possible, and the
full rental will be refunded. The tenant will have no further claim against the owners.
Again we advise you purchase a suitable travel insurance product to cover you in case you can’t
travel due to Jury Service, illness, self isolation or quarantine for example. These events can be
covered by you taking out travel insurance, as you would not be entitled to refund at such short
notice. There are a number of policies that include cover for illness with Covid and self isolation
and a lot of bank annual travel policies also cover this.
Arrivals and Departures
Òran na Mara will ready for your arrival from 4.30pm. You will be provided with pre-arrival
information with instructions on accessing the house. You must depart the house by 9.30am on the
date of departure. Housekeepers reserve the right to enter the property at 9.30am to begin
changeovers.
Occupancy
The maximum occupancy of Òran na Mara is 6 people including children, plus a cot which is available by arrangement including linens. If you have contacted us and made a special arrangement reserving the house for one or two bedrooms only, you may not occupy additional bedrooms or their en-suite bathrooms.
Children under 16 must always be under parental supervision and must not be left alone in the property.
We do not allow parties in the house involving people who are not registered guests. We reserve
the right to terminate a rental or remove people from Òran na Mara in the event of unreasonable
behaviour, excess noise, damage to the property or exceeding the agreed occupancy. Any refund
will be at the sole discretion of the owner.
Cleaning and Maintenance
The property should be left in a clean and tidy state on departure. During your stay you will be
responsible for and have to pay for any damage you or your guests (including pets) cause to the
property, its contents or surroundings. Any damages or losses should be reported to the manager
and will be chargeable. If the house is left in an inappropriate state an additional cleaning charge
will be made.
Fresh linens and towels are provided for your use during the stay, and will be changed every
Saturday if you have a stay longer than one week unless you notify us otherwise.
We reserve the right to access the property by arrangement with you if we have to undertake
essential maintenance. We will provide a local contact number in case you have emergency
maintenance or cleaning requirements.
Included Facilities
All electric is included in the rental along with a supply of logs for the wood burner.
The house has free superfast broadband, a surround sound system and smart TVs for your enjoyment. Please sign
out of any personal film or music accounts before departure,as if you do not do this we cannot
be responsible for any subsequent purchases made.
There is a landline for making and receiving calls. All calls to UK landlines and mobiles are free of charge.
If you wish to charge an EV, this is a booking extra per vehicle and once selected you have unlimited use during your stay. A standard plug must never be used to charge a vehicle (granny charging).
As we continue to improve the guest experience, we reserve the right to change or amend
facilities provided.
Dogs
Òran na Mara is a dog-friendly house so we allow one or two small well-behaved dogs. Dogs
must not be left in the house alone, and are not allowed on soft furnishings or in bedrooms. Any
pet damage will be charged. Dogs should be included on your booking as extras. Please clean
up after your dogs in the grounds of the house.
Smoking
Òran na Mara is strictly a no-smoking property inside and throughout the grounds.
Personal property
All personal property, including vehicles and their contents, are left at the risk of the owners. We
are not responsible for any losses, damage or injuries other than where we are at fault.
House Rules
House rules will be provided in the house as well as on digital guest information provided before you arrive, and you agree to follow these rules during your stay.
Restrictions
We are not responsible for events outside our control, such as power cuts. Although power cuts
are rare, there are power cut facilities such as torches and a portable gas stove.
Òran na Mara is a thatched property. It is an insurance requirement that no naked flames are
used other than supplied cooking facilities within the grounds of the property. The BBQ must not
be used within 3 metres of the roof line.
Adverse weather and travel
We strongly advise booking ferry crossings at the time of making a reservation as on occasion
ferries become full. We cannot be held responsible for non-arrival due to ferry, boat, aircraft or
other public transport capacity limitations or cancellations due to adverse weather, industrial
action, or for vehicle breakdown. No refunds will be given.
In the event of travel disruption preventing you leaving the island, please contact the owner, failing
which the provided local contact.
Again, we strongly advise that holiday insurance is taken out. You may lose the whole rental cost
in certain circumstances.
Data Protection
Òran na Mara will not disclose any personal details provided to other parties for any purpose. If
you wish your details to be removed from Òran na Mara’s records following your visit, please let
us know.
